Intellectual Property

This Department handles contentious and non-contentious work.

The Department prosecutes trade mark applications, patent applications and design applications in most developed and developing countries. The Firm regularly receives instructions from both local and overseas corporations to manage their intellectual property portfolios on a regional or worldwide basis. The Firm is a member of several reputable international associations and works closely with members of these associations on overseas applications.

The Firm handles large number of registration applications not only in Hong Kong but also in many countries in the world, particularly in Asian countries such as China, Cambodia, Laos, Vietnam, Taiwan, Singapore, Malaysia, Thailand, Japan and Korea.

The Department also handles contentious intellectual property cases, including trademark opposition proceedings, rectification proceedings, cancellation proceedings and infringement proceedings. The Firm has been instructed by a number of foreign corporations to design and manage an anti-counterfeiting programme on their behalf and such programme includes the use of private investigative agencies to conduct market monitoring, issue of legal proceedings, regular lobbying with relevant government authorities, and organizing educational seminars for the public and specific trade bodies.

The evolution of the domain name registration system is causing growing concern for trademark owners.
Many infringers (most notably from China) register reputable trademarks as their domain names with the intention of misleading the public that they belong to the China branch of or have business connection with the trademark owners and thereby gain substantial commercial advantage by selling goods in direct competition with the trademark owners.  This Firm has been acting on behalf of multinational organizations in various domain name dispute cases before the Asian Domain Name Dispute Resolution Centre and have been successful in all cases so far.

The Firm enjoys a strong reputation for its intellectual property expertise amongst its fellow practitioners, both locally and internationally.
